Please read these Terms of Service (“Terms”) carefully before using the resources provided by Legacy Insurance and Financial Services (the “Company”), applying to become an insurance agent for the Company, or otherwise seeking affiliation with the Company.

IMPORTANT—THESE TERMS CONTAIN AN ARBITRATION AGREEMENT, JURY AND CLASS ACTION WAIVERS, LIMITATIONS OF LIABILITY, AND OTHER PROVISIONS THAT AFFECT YOUR LEGAL RIGHTS.

Use of Resources: Your use of the Company’s website, customer relationship management software, agent portal, leads, and any commissions or compensation received from insurance carriers affiliated with the Company (collectively, “Resources”) is conditioned upon your acknowledgment, agreement, and compliance with these Terms. These Terms apply to all insurance agents that sell or market products in affiliation with the Company or via the use of any Resources. By using the Company’s Resources, you consent to be bound by these Terms. If you do not agree with any part of the Terms, you must immediately notify the Company and discontinue your relationship with the Company. All Resources are provided “as is” without warranty of any kind, express or implied.

Outbound Communications and Compliance with Law In connection with your activities related to marketing and sale of insurance products involving the Company. Do not sell leads obtained from or through the Company unless explicitly authorized. Avoid using auto dialers, spam texts, prerecorded messages, artificial voice calls, or engaging in prohibited telemarketing practices. Obtain proper consent before contacting leads, and adhere to DNC registry laws and regulations. Comply with federal and state laws including TCPA, TSR, CAN-SPAM Act, HIPAA, CCPA, and Medicare guidelines as applicable.

Communication with Agents. As an agent, you authorize the Company to contact you regarding the sale of insurance products using phone, email, text, voicemail, or other methods. You may opt out of communications by notifying the Company of your preferences.

Independent Contractors Unless specified as employee agents, all agents are independent contractors and not employees of the Company. Agents determine their work methods and are not considered partners, joint venturers, nor agents of the Company.

Trademarks The Company’s trademarks, including its name, logo, and related designs, are proprietary to the Company or its affiliates or licensors. Use of these trademarks requires prior written permission from the Company.

Indemnification: You agree to defend, indemnify, and hold the Company and its affiliates harmless from any claims, liabilities, costs, or damages arising from your violation of these Terms or misuse of Resources.

Limitation on Liability To the extent permitted by law, the Company shall not be liable for any indirect damages arising from these Terms or use of Resources. Liability is limited to the greater of $1,000 or amounts paid by you to the Company for access to and use of the Resources.

Agreement to Arbitrate Any disputes arising under these Terms or from use of Resources will be resolved through binding arbitration in Dallas, Texas, excluding trial by jury and barring participation in class actions. The arbitration process shall be governed by AAA rules.

Waiver and Severability Any waiver of these Terms must be in writing and signed by the Company. Unenforceable provisions will be modified to reflect the parties’ intention while remaining provisions remain effective.

Changes to Terms Legacy Insurance and Financial Services reserves the right to modify these Terms at any time. Changes will be communicated through the Company’s website or by direct communication.
